Compensation

Most of the time as a suspect in case of an acquittal or a dismissal you are entitled to compensation. The costs that are eligible for compensation include:

  1. The fee of the attorney;
  2. Travel and subsistence expenses incurred as a result of the investigation and court hearing(s);
  3. Compensation for the damage as a result of time loss due to the prosecution and court hearing(s); 
  4. Reimbursement for the days you spent in custody.

In case of a dismissal or an acquittal, the guidelines of the court state that in principle the compensation for spending a day in a prison cell is €130,- per day and for spending a day in a detention center €100,- per day. You are only entitled to damages after the first phase of police custody (the first nine hours in principle) is over.

In some situations you are, even though your cases had not been dismissed an you have not been acquitted, entitled to compensation for the time you spend in custody. You are also entitled to compensation if you have only been convicted of an offence for which pre-trial detention is not permitted.
